Complying with the Asbestos Management Code

Under Workplace Health and Safety Regulation (2011) which came into force on 1st January 2012, if you are the “person in control of a business or undertaking (PCBU)” or a "person with management or control of a workplace (PCMW)" you are responsible to find out if your building contains asbestos if it was built before 2004.

Persons in Control of a building have a duty of care to:

  • Investigate their premises for the presence of asbestos containing material (ACM).

  • Create an Asbestos Register of ACM, (from 1 January 2012 this is required even if no ACM is found).

  • Develop an Asbestos Management Plan.

  • Remove or contain the ACM.

  • Implement control measures.

  • Ensure their building complies with both State and National Asbestos legislation.
